Terms & Conditions

  • Ring or e-mail to check if the boat is still available for the week wanted and to make the reservation

  • Print out the Booking Form, and send it together with your deposit to Norbury Wharf

  • The reservation will be held for you for 3 days pending arrival of the form.

  • Alternatively reservations can be made by credit card, the Booking Form to arrive as soon as the post allows.

Pontcysylite Aquaduct

    1. Booking

The booking is confirmed when a completed form signed by the hirer together with the deposit of 20% has been received by us and a booking conformation has been issued.

The balance of the hire fee is payable 6 weeks before the holiday start date.

    2. Cancellation

Cancellation: Holiday cancellation must be notified to us by phone and in writing.  If you cancel your holiday at any time or for any reason you will incur a cancellation charge of 20% of the value of the booking.

Late Cancellation charges: If the cancellation is notified to us later than six weeks before the start of the booked period you will also be liable for the balance of the value of the booking.

We will endeavour to re-let all or part of the cancelled booking and will reduce the amount of any late cancellation charges by the amount of the re-lettings.  If we are unsuccessful you will remain liable for the full value of the holiday.

Day Boat Hire deposit is non refundable.  A credit note will be given.

 

                     3. Reduced Cruising Terms (November to Easter)

During this period British Waterways may impose stoppages for maintainance purposes which are beyond Norbury Wharf's control.  This could restrict the extent of your proposed cruise but does not constitute grounds for cancellation of your holiday or refunds of any kind.  The tariff for this period already reflects this possibility.

    4. Hirers

We will not hire a boat to anyone under the age of 18. No person under 18 may control a boat unless under the direct supervision of a responsible adult.

No boat may carry more persons than the licence permits.

Please phone us before you book if there are any infirm or disabled persons in your group. We will help if we can but practical considerations of the suitability of the waterways is beyond our control.

    5. Company Reservation

We also reserve the right to refuse to hand over a boat to any person who in our opinion is not suitable to take charge of the boat. In this event the hire charge will be refunded in full and you will have no further claim upon us.

If, owing to circumstances beyond our control, we are unable to provide the boat booked, or a suitable alternative, we will refund the full price of the holiday and you shall not have any further claim against us.

    6. Hire Period

Boats may be collected from 3 p.m. on the start day and tuition will be given by a member of staff. Boats must be returned in a clean condition by 9.00 a.m. to the base and vacated by 10.00 a.m. prompt. It is your responsibility to ensure that sufficient time is allowed to return to the base on time. It is a condition of hire that boats are returned to the boatyard.  Failure to do so will result in the loss of your deposit or a surcharge.

    7. Fuels, Pump outs

The boat is handed over with a full diesel tank, three full gas bottles and with the toilet holding tank pumped out.  This will normaly suffice for a weeks cruising.  Hirers are advised that additional fuels and pump-outs are necessary on longer cruises.  Any additional fuels or pump-outs required during the period of hire are the hirer's responsibility.

    8. Damage Deposit

The damage deposit, of £250, will be required before the boats can be taken out. This will be refunded in full upon the boat being returned on time, undamaged, in a cleaned condition and with no damaged or missing equipment. 

     

    9. Repairs

Repairs are our responsibility and should not be put into the hands of others without our authority.

    10. Delays

We are not responsible or liable for damage or loss beyond our reasonable control including (without limitation), death or personal injury of hirers, their crew and passengers: loss or damage to property: non-fulfilment or interruption of the booking or delays: breakdowns; mechanical problems; defects; damage; restrictions or obstructions; repairs or damage to waterways; non-availability of routes; navigational works; storms; floods; droughts; ice; loss or shortage of water or other weather conditions; rationing; shortage or non-availability of fuel; or in respect of any consequential loss, damage, expense, injury or claim.

    11. Navigation and Accidents

You are responsible for the safe navigation of the boat in your charge and are expected to comply with the navigation bylaws, including those relating to speed and cruising after dark or in fog, which are forbidden.

The towing of other boats or using tidal waters without consent is also forbidden.

In the case of an accident you must notify us immediately with full details including names and addresses of any witnesses and the name of any other boat involved. In no circumstances should anyone admit liability.

If you are involved in an accident which subsequently is the subject of an insurance claim, you will be liable to reimburse us for any losses we incur, limited to £350.

    12. Car Parking

Free car parking is provided for up to 2 vehicles, but we emphasise that we accept no liability for loss or damage to vehicles or their contents. You are particularly advised not to leave any valuable or readily portable items in your vehicles.

Property left on boats can only be returned after receipt of agreed postage and packing charges.

    13. Pets

Where one well behaved pet is allowed you must provide your own pet baskets, blankets and all equipment. Pets must not be left unattended and are not allowed on bedding or chairs.  In the case of damage being caused by your pet you will be held responsible for the cost of repairing such damage.

    14. Equipment

Use of your own electrical equipment on board is entirely at your own risk.  You will be held responsible for the cost of repairing any damage caused by such use.

    15. Brochure

We try to make the descriptions of boats in this brochure accurate but we are not liable for minor inaccuracies that may exist. Any maps or plans are not to scale.

    16. Complaints

We operate to a high standard and would like you to relay any problems not noticed on collection before you start your holiday, or arising during your holiday as soon as possible, so that they can be corrected.

To enable us to deal with any complaints properly, please send details in writing to Norbury Wharf Limited within seven days from the end of your cruise.

We cannot be held responsible or liable if you return the boat early due to your personal circumstances or weather conditions.

                     17. Fuel Surcharge

In the event of increases in fuel tax, we reserve the right to impose a fuel surcharge to cover our increased costs even after a booking has been confirmed.
